Welcome to WhamComics (“WhamComics,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of WhamComics and related products and services.

By accessing or using our services, you agree to these Terms.

If you do not agree to these Terms, please do not use our services.

1. Overview of Services

WhamComics provides personalized AI-assisted comic book creation services, including:

  • custom stories

  • personalized artwork

  • digital previews

  • printed comic products

  • downloadable digital products where available

Comic content is generated using a combination of customer-provided information and AI-assisted creative tools.

2. Eligibility

You must be at least 18 years old to purchase products or use our services.

By using WhamComics, you represent that:

  • you are legally able to enter into this agreement

  • all information you provide is accurate

  • you have authority to upload submitted content

3. User Content and Uploads

Users may upload:

  • photos

  • images

  • names

  • character descriptions

  • written prompts

  • personalization information

By uploading content, you confirm that:

  • you own the content OR have permission to use it

  • the content does not violate laws or third-party rights

  • the content does not infringe copyrights, trademarks, or privacy rights

  • the content does not contain unlawful, abusive, hateful, sexually explicit, or harmful material

You grant WhamComics a limited, non-exclusive license to use uploaded content solely for:

  • generating personalized comics

  • producing previews

  • fulfilling orders

  • providing customer support

WhamComics does not claim ownership of your uploaded content.

4. Prohibited Content

Users may not upload or request content involving:

  • illegal activity

  • hate speech

  • explicit sexual content

  • graphic violence

  • harassment or abuse

  • copyrighted material without permission

  • impersonation or deceptive use of another person’s identity

WhamComics reserves the right to reject or remove content at our discretion.

5. AI-Generated Content Disclaimer

WhamComics uses AI-assisted tools to generate artwork and stories.

Because AI-generated content is inherently variable:

  • outputs may differ from expectations

  • character appearances may vary slightly

  • visual or story inconsistencies may occur

  • final printed products may differ slightly from digital previews

WhamComics does not guarantee perfectly identical results across all generated pages or products.

6. Orders and Payments

All prices are listed in U.S. dollars unless otherwise stated.

Payments are processed securely through third-party payment providers such as Stripe.

By placing an order, you authorize payment for:

  • product costs

  • shipping fees

  • applicable taxes

Orders may not be canceled once production has started.

7. Refunds and Replacements

Because products are personalized and custom-made:

  • refunds are generally not available once production begins

  • digital products may be non-refundable

  • replacement products may be offered for:

    • printing defects

    • damaged shipments

    • fulfillment errors

Minor AI inconsistencies, artistic differences, or subjective dissatisfaction do not automatically qualify for refunds.

8. Shipping and Fulfillment

Production and fulfillment times are estimates and may vary.

WhamComics is not responsible for delays caused by:

  • shipping carriers

  • customs processing

  • weather

  • supply chain interruptions

  • third-party fulfillment providers

We are not responsible for incorrect shipping addresses provided by customers.

9. Intellectual Property

The WhamComics name, branding, logos, website content, and platform design are owned by WhamComics and protected by applicable intellectual property laws.

Users may not:

  • copy

  • reproduce

  • resell

  • modify

  • distribute

any portion of the website or service without written permission.

10. Limited License for Personal Use

Customers may use purchased comics for personal, non-commercial use.

Commercial resale, redistribution, or mass reproduction of WhamComics products without permission is prohibited.

WhamComics may rely on third-party providers, including:

12. Limitation of Liability

To the maximum extent permitted by law, WhamComics shall not be liable for:

  • indirect damages

  • incidental damages

  • emotional distress

  • lost profits

  • data loss

  • dissatisfaction arising from subjective artistic preferences

Our total liability shall not exceed the amount paid for the affected order.

13. Indemnification

You agree to defend and hold harmless WhamComics, its owners, affiliates, contractors, and partners from claims arising from:

  • your uploaded content

  • your misuse of the service

  • violation of these Terms

  • infringement of third-party rights

14. Account Suspension or Termination

WhamComics reserves the right to suspend or terminate access to users who:

  • violate these Terms

  • engage in abusive behavior

  • submit prohibited content

  • attempt fraud or misuse of the platform

15. Changes to These Terms

We may update these Terms periodically.

Updated versions will be posted on this page with a revised effective date.

Continued use of the service after updates constitutes acceptance of the revised Terms.

These Terms shall be governed by the laws of Ohio, without regard to conflict of law principles.
